Neal & Leroy, LLC Files an Appeal on Behalf of the Chicago Transit Authority Pro Bono

Neal & Leroy, LLC as a public service represents the Chicago Transit Authority in the United States Court of Appeals for the Seventh Circuit and recently filed a brief on behalf of the CTA. The firm filed the appeal on behalf of the CTA pro bono, seeking to reverse the judgment of the trial court that had prohibited the CTA from acquiring trackage rights on the Green Line from the Union Pacific Railroad Company. The CTA runs Green Line trains on a two-mile right of way leased from the Union Pacific. The CTA sought to buy or condemn these trackage rights permanently to avoid paying monthly rent and to forestall the possibility of losing those rights, which was possible under the terms of the lease.

The brief on behalf of the CTA was prepared by Richard F. Friedman and Jacinta Epting, who also represented the CTA in the trial court. In the appeal, the Union Pacific will file its appellee’s brief, and Mr. Friedman and Ms. Epting will prepare the CTA’s reply. The case is expected to be heard before the federal appeals court during the summer. Union Pacific R.R. Co. v.
