David P. Winters
David P. Winters focuses his practice in
the areas of construction law, dispute resolution and mediation, litigation,
public procurement, project finance, and public-private partnerships.
Mr. Winters has been developing and implementing public-private partnerships
throughout his career. On behalf of a consortium of international airlines,
Mr. Winters formed a corporation to install and operate common-use airline
equipment at International Terminal 5, Chicago O’Hare International Airport.
Mr. Winters then moved to the public side, joining the City of Chicago’s
Department of Law, where he worked with the airlines operating at Chicago
Midway Airport to develop a new terminal facility for the airport. Mr.
Winters also negotiated the master concession agreement for O’Hare which led
to the first wholesale transformation of food and gift offerings at the
airport. As the City's Deputy Purchasing agent responsible for aviation
matters, he assembled the bid package and awarded the contract for
construction of the new terminal at Midway.
While in-house with the Metropolitan Pier and Exposition Authority, Mr.
Winters handled transactions from the development, design and construction
of the West Building at McCormick Place to licensing agreements for
concessions at Navy Pier, and management agreements for the McCormick Place
hotel and catering and concessions agreement at both facilities. After
returning to the City’s Law Department to assist in the commencement of
construction for the O’Hare Modernization Program, Mr. Winters returned to
the private sector at Neal & Leroy, where he continues to work with both
public and private clients to the mutual benefit of the parties involved in
each transaction.
Recent transactions include the Systems Integration Agreement between the
Public Building Commission of Chicago and Motorola Solutions, Inc., for the
further development of Chicago’s Operation Virtual Shield, the contract for
the replacement of the City’s vehicle fleet with Zipcars, and, on behalf of
the PBC, Construction-Manager-at Risk Agreements for the Ogden School and
Jones High School for the Performing Arts.
In addition to his transactional work, Mr. Winters has been resolving claims
and disputes throughout his career. He currently represents the City of
Chicago in multi-million dollar litigation with a design team and builder
concerning work at O’Hare, and is a certified mediator with the Circuit
Court of Cook County. Mr. Winters serves as a volunteer mediator with the
Court’s Foreclosure Mediation Program.
